Privacy Policy and Terms and Conditions
Last updated: 22 Nov 2024
This document informs you of our policies regarding the collection, use and disclosure of
Personal Information we receive from users of our website and our apps. It also lets you know about how third-parties are involved. It also gives you a non-exhaustive list
of terms and conditions under which our products are offered.
DO NOT PURCHASE OUR PRODUCT(S) IF YOU DO NOT AGREE TO THESE TERMS. DO NOT USE OR FURTHER VISIT THIS WEBSITE IF YOU DO NOT AGREE TO THESE TERMS.
By using the site and/or our apps, you agree to the collection and use of information in accordance with this policy.
While using our site and/or our apps, we may ask you to provide us with certain personally identifiable information
that can be used to contact or identify you. Personally identifiable information may include, but is not
limited to your name, email address, physical address, and/or phone number.
In the case of certain apps downloaded via our website, it is, for reasons of anti-piracy and license assignability,
mandatory to provide real and verifiable personal information when activating the products. In the case of our
apps purchased from third-party websites, such as popular "app stores" and "app markets" for various devices,
it is generally unnecessary to do this as the app store itself does the necessary and sufficient identity and
license verification.
In some of our apps, including those purchased or obtained via third party "app stores" and "app markets", we
may include features that are only accessible if you provide us with certain identifying information. Such features
are typically optional and are generally the sort that allow you to synchronize your information with our apps
on other devices you may have. It may also allow you to share your information, if you wish and explicitly make
it known that you wish, with others, depending on the actual app.
Some of our services are subscription and/or account based. For subscription and/or account based services, you will need to provide
us with personally identifiable information such as your name, email address, physical address, and/or phone number.
As fake and/or incomplete information can represent a security or piracy risk, we reserve the right to, without notice,
suspend or terminate the accounts or provision of service to those who have provided false and/or incomplete information.
Like many site operators, we collect information that your browser sends whenever you visit our Site and/or use our apps
("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address,
browser type, browser version, the pages of our Site(s) that you visit, the time and date of your visit,
the time spent on those pages and other statistics. In addition, we may use third party services such as
Google Analytics that collect, monitor and analyze this. In the case of our own apps, analysis of such log data both
in aggregate and in specific cases helps us improve our offerings. Our technical staff may therefore at times need
to look at your log data.
Our goal is to provide you with high quality apps and services. As part of such, we may occasionally contact you
via the information that you have provided to us. This may include emails and phone calls but NEVER mass-market ones. Rather,
you may be contacted individually by an actual human if there is a pressing, reasonable need to contact you. For example,
at times, we have contacted users to offer them personalized or urgent tech support via phone when, at our sole discretion,
circumstances deemed this appropriate. To date we have never had any issue in the few times we have done this, but if you do not
want us to contact you in this way, just let us know.
All but the most urgent of
emails from us can be opted out of via a preferences link found in each email. We reserve the right to send out
particularly urgent emails regarding our products (such as critical updates) to all of our users who we can with reasonable
accuracy identify as using affected apps or services.
Cookies are files with small amount of data, which may include an anonymous unique identifier.
Cookies are sent to your browser from a web site and stored on your computer's hard drive.
Like many sites, we use "cookies" to collect information. You can instruct your browser to refuse all
cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may
not be able to use some portions of our site and/or apps.
The security of your Personal Information is important to us, but remember that no method of
transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to
use commercially acceptable means to protect your Personal Information, we cannot guarantee its
absolute security.
If you buy our products or apps via third-party stores, the terms, conditions, and privacy policies of such third party stores will apply.
Sometimes, when you buy our products or apps via third-party app stores, you will need to do things like enter your email address
or personal information so that we can implement a positive user experience for you (keep your accounts / info consistent across platforms
and devices).
When you buy products via our website, additional terms and conditions in addition to those found here may apply. These will generally
be made clear during the purchase or checkout process. All potentially relevant terms and conditions, including those found here, those
found in our general checkout processes, and those indicated by any partner and associated companies will apply. If terms should in any
place disagree, the interpretation and choice most favorable to Dauntless will apply. Terms and conditions include both those explicitly
listed as "terms and conditions" and the collective guidance of our web pages, communication with our personnel, and occasionally
inside products themselves.
Payment is normally expected in full before products are delivered. Accounts in default will at minimum have their products
suspended or returned without any right refund. Unless otherwise clearly specified, payment is due before products are delivered. If for whatever reason you have not paid for products
that have been assigned to you or if your account falls into default by virtue of not having paid for all of the items(s) that you have agreed
to pay for, any and all of your products may be disabled or removed at our discretion. Removal of products is not the limit of our remedies
for non-paid-for-use.
Returns Policy: our products are non-returnable, non-exchangeable, and non-cancellable. With reference to products purchased via our website including our PC-based software, and subscription-based services purchased via our website (such as safelogweb.com) - purchases made there are strictly non-reversible and non-cancellable. Most or all of our products so
available have a demo period or demo version available. Users are welcome and encouraged to avail themselves of any demo prior to purchase and to make a thorough evaluation of the
technical and content suitability of the product(s) in question prior to purchase. Most of all of our checkout processes have clear, plain-English further terms of sale that emphasize this.
Should you have questions while in the demo mode, please reach out to us and ask - do not assume anything. Once the purchase is made, your order will be final and will be strictly
non-cancellable, non-exchangeable, and non-returnable. This also applies if you purchase for the "wrong platform", such as if you purchase our PC software when later you decide you
would have preferred it for an Apple device. Again, our checkout term is abundantly clear with multiple confirmation and re-confirmation steps reminding you of what platform you
are purchasing for and generally includes at least one explicit acknowledgement of platform, terms, non-refundability, and more prior to the checkout screen. Our view is that users
are responsible for the clicks they make.
Further ...
If you are (generally an organization or institution) and purchase items with a "time to pay", such as "Net 30", "Net 15", etc, you understand that your
entering into such a purchase agreement indicates your firm commitment to pay for the products in question. "Time to pay" does not in any way
constitute an option for the buyer to withdraw from the purchase agreement.
If at any time you want your data to be removed entirely from our systems, we will honor such requests promptly and as required by law. This includes
full compliance with EU "Right to Be Forgotten" laws.
This Privacy Policy is effective as of the date at the top and will remain in effect except with respect to any
changes in its provisions in the future, which will be in effect immediately after being posted on this
page and without notice.
We reserve the right to update or change our policies, including this one, at any time and you should check this
Privacy Policy periodically. Your continued use of the Service after we post any modifications to the
Privacy Policy on this page will constitute your acknowledgment of the modifications and your
consent to abide and be bound by the modified Privacy Policy
Our products are made available on a best-effort basis. No guarantees or warranties of any sort are made
regarding their correctness, suitability, or availability for any purpose whatsoever. Under no circumstances
will will be responsible for any direct, indirect, or consequential costs or damages associated with the use,
misuse, or unavailability of our product(s). We specifically disclaim use of our products in any legalistic,
regulatory, safety-related, or operational context.
If you have any questions about this Privacy Policy, please contact us.
